TERMS OF SERVICE AND USE

Welcome to the website of Realtybates, Inc., a licensed California real estate brokerage (DRE 01527355) (“Company,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, mobile applications, and online services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.

1. SCOPE OF SERVICES AND NO IDX DATA FEED

Our Services are designed to provide information about our brokerage, our licensed agents, and residential or commercial properties listed exclusively by Realtybates or directly authorized for display by our clients. Unlike third-party aggregator portals, this website does not participate in or display an Internet Data Exchange (IDX) feed, Multiple Listing Service (MLS) public compilation feed, or Virtual Office Website (VOW) data pool belonging to other brokerages. All property listings displayed on this site are proprietary to our brokerage, represent our own exclusive listings, or are office exclusives permitted under California law and relevant local MLS rules.

2. ELIGIBILITY AND ACCOUNT REGISTRATION

You must be at least 18 years of age and a resident of the United States to use our Services. To access certain features, you may be required to register for an account. You agree to provide accurate, current, and complete information and to protect your account password. You are responsible for all activities that occur under your account.

3. PROPRIETARY RIGHTS AND INTELLECTUAL PROPERTY

All content on the Services — including text, graphics, photographs, logos, illustrations, data compilations, page layouts, and software — is the property of the Company or its content suppliers and is protected by United States and California intellectual property laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to access the site for personal, non-commercial use only. You may not scrape, crawl, frame, copy, reproduce, distribute, or modify any portion of our listing data or media assets without explicit written permission.

4. USER CONDUCT AND PROHIBITED USES

You agree not to use the Services for any unlawful purpose or in any way that violates these Terms. Prohibited conduct includes, but is not limited to: submitting false, misleading, or fraudulent inquiries; attempting to interfere with the proper working or security infrastructure of the website; using automated systems (robots, spiders, or scrapers) to extract listing information, pricing data, or agent contact details; impersonating another person or misrepresenting your affiliation with any person or entity.

5. DIRECT, NON-AUTOMATED COMMUNICATION

When you submit an inquiry, request information through our contact forms, or provide your phone number or email address to our brokerage, you are initiating a request to correspond directly with a licensed professional. Personal Correspondence: All responses, follow-ups, and property updates sent by our team are handled individually and manually by our agents or staff. We do not use automated marketing robo-dialers, mass text-broadcasting software, or algorithmic lead-nurturing bots to contact you. Revocation: If you wish to cease manual communications with any agent, you may simply notify that agent directly via email or phone, and they will manually update their files to stop future outreach.

6. CALIFORNIA REAL ESTATE COMPLIANCE & DISCLOSURES

The Company is a real estate broker licensed by the California Department of Real Estate (DRE). All real estate brokerage activities, representations, and communications conducted through the Services comply with the California Business and Professions Code and DRE Regulations. Fair Housing: We fully support and comply with the Federal Fair Housing Act and the California Fair Employment and Housing Act (FEHA). We do not discriminate based on race, color, religion, sex, handicap, familial status, national origin, sexual orientation, gender identity, or any other protected class. Accurate Representation: While we strive to ensure that our proprietary listings, pricing, and availability are accurate and up to date, all information is subject to errors, omissions, prior sale, or withdrawal without notice. Users are advised to verify all property details independently with a licensed professional.

7. NO RELATIONSHIP ESTABLISHED

Your use of the Services, including submitting an inquiry via an online contact form, clicking “Contact Agent,” or scheduling a viewing, does not create an exclusive brokerage-client relationship or agency relationship between you and the Company. An agency relationship is only formed when an explicit, written representation or listing agreement is signed by both parties in accordance with California Civil Code guidelines.

8. DISCLAIMER OF WARRANTIES

THE SERVICES AND ALL CONTENT, LISTINGS, AND MATERIALS PROVIDED THEREIN ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER CALIFORNIA LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL THE COMPANY, ITS LICENSED BROKERS, AGENTS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company and its agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or connected with your violation of these Terms, your misuse of the Services, or your violation of any third-party rights.

11. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be resolved exclusively and be submitted to the Judicial Arbitration and Mediation Service (JAMS) with venue in San Mateo, California. Any arbitration finding shall be binding on the parties.

12. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will post the revised Terms on this webpage and update the “Effective Date” at the top. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
